In the event that our customer service team is unable to resolve your concern, by using this Site you unconditionally agree that all claims relating to your access or use of our Site, including all disputes arising out of, or related to, any products or services purchased from Zebulun FashionSquare through our Site, will be resolved entirely through binding individual arbitration, rather than in court. You may also assert individual claims in small claims court if your claims otherwise qualify. The Federal Arbitration Act and federal arbitration law apply to this agreement. These Terms of Use do not apply to any claims or disputes relating to or arising from use of your Zebulun FashionSquare credit card; any such claims or disputes will be governed by the terms and conditions of your Zebulun FashionSquare credit card.

Note: There is no judge or jury in arbitration, no class actions, and court review of an arbitration award is limited. An arbitrator, however, can award on an individual basis the same damages and relief as a court, including injunctive and declaratory relief or statutory damages, and must follow these Terms of Use as a court would.

You agree that the arbitration will be conducted by either the American Arbitration Association (“AAA”), adr.org, 1.800.778.7879, or the Judicial Arbitration and Mediation Services (“JAMS”), jamsadr.com, 1.800.352.5267. You can contact AAA or JAMS to find out more information on how to commence an arbitration proceeding. Payment of all filing, administration and arbitrator fees will be governed by the AAA’s or JAMS’ applicable rules. Likewise, Zebulun FashionSquare will not seek attorneys’ fees and costs in arbitration. You may choose to have the arbitration conducted by telephone, based on written submissions, or in person in the county where you live or at another mutually agreed location.

We each agree to bring any dispute in arbitration on an individual basis only, and not on a class, consolidated, representative or collective action basis. If for any reason a claim proceeds in court rather than in arbitration, we each waive any right to a jury trial or to participate in a class action against the other. In addition, we both agree that we each may bring suit in court to enjoin infringement or other misuse of intellectual property rights.

THIS SECTION LIMITS CERTAIN RIGHTS, INCLUDING THE RIGHT TO MAINTAIN A COURT ACTION, THE RIGHT TO A JURY TRIAL, THE RIGHT TO PARTICIPATE IN ANY FORM OF CLASS OR REPRESENTATIVE CLAIM, THE RIGHT TO ENGAGE IN DISCOVERY EXCEPT AS PROVIDED IN AAA OR JAMS RULES, AND THE RIGHT TO CERTAIN REMEDIES AND FORMS OF RELIEF. OTHER RIGHTS THAT YOU OR ZEBULUN FASHIONSQUARE WOULD HAVE IN COURT ALSO MAY NOT BE AVAILABLE IN ARBITRATION.

Applicable Law
The law applicable to the interpretation and construction of these Terms of Use and any transaction (including purchases made on this Site) using or related to the Site, shall be the Federal Arbitration Act, applicable federal laws and the laws of the State of Texas, USA, without regard to principles of conflict of laws, but subject to the Federal Arbitration Act and other federal law relating to the arbitrability of claims. You agree that all matters relating to your access to or use of the Site, including all disputes, will be governed by the laws of the United States and by the laws of the State of Texas.

Merchandise Availability
Merchandise availability on our Site is not guaranteed as it may be low in stock. If merchandise is not available by the time your order processes, we will notify you of this via email.  You will receive a shipping confirmation email once your items have shipped.

Zebulun FashionSquare products displayed on the Site may be available in selected Zebulun FashionSquare stores in the United States. The prices displayed on the Site are quoted in U.S. dollars, unless otherwise indicated.

Please note that while we have tried to accurately display the colors of products, the actual colors you see will depend on your monitor and may not be accurate.

Denial of Access 
These Terms of Use constitute an agreement that is effective unless and until terminated by Zebulun FashionSquare. If in Zebulun FashionSquare’s sole discretion you fail to comply with any term or provision of this agreement, Zebulun FashionSquare may deny you access to the Site. Pricing Policy

Competitor Price Matching 
We are committed to offering you the best possible prices. If you find an item that we offer, in the same color and size, in stock at a similar retailer, we’ll be glad to meet a competitor’s price. Please email pricing@zaiylee.com to place your order.

We are unable to match prices from auction, outlet and discount stores, non-U.S.-based stores and websites. Other retailers’ discount promotions, shipping offers and gift card offers are also not eligible.

Zebulun FashionSquare Sale Adjustment 
If within two weeks of your order date, we permanently reduce the price of an item you purchased, we’ll happily adjust the sale price for you.

Please note that we can only make one sale adjustment per item. The item must be in the same color and size, and in stock at Zebulun FashionSquare. All designer goods originally purchased at a sale price and items included in special Extra Savings events are excluded from any adjustments.

Pricing Errors 
We work hard to ensure the accuracy of pricing. Despite our efforts, pricing errors may still occur. If an item’s price is higher than the price displayed, we will cancel your order of that item and notify you of the cancellation.

Shopping Bag 
Items in your Shopping Bag reflect the current price displayed on the item’s product details page. Please note: this price may differ from the price displayed when the item was first placed in your Shopping Bag.
Our merchandise is offered for sale by Zebulun FashionSquare for your personal enjoyment and not for resale. Therefore, we reserve the right to limit quantities and refuse to sell to any person who we believe may be purchasing for resale.

Sales Tax

STATE & LOCAL SALES TAXES 
Taxes that appear in your online order confirmation are estimated. Because orders may be fulfilled from multiple locations across the U.S., the actual taxes charged to your credit card will be calculated based on the applicable state and local sales taxes when your order is shipped.

The terms contained herein are subject to change as the taxation of online transactions is continually evolving. Zebulun FashionSquare strives to comply with state and local tax laws as they exist currently, and continues to monitor and update its taxation policies as those laws change.

States & U.S. Territory Where Zebulun FashionSquare Collects Sales Taxes 
Orders shipped to TX will have all applicable local and state sales taxes added to your total order, and to your shipping charges where appropriate.

States Where Zebulun FashionSquare Does Not Collect Sales Taxes 
Zebulun FashionSquare does not collect sales or use taxes in all states. For states imposing sales or use taxes, your purchase may be subject to use tax unless it is specifically exempt from taxation. Your purchase is not exempt merely because it is made over the Internet or by other remote means. Many states require purchasers to file a sales/use tax return at the end of the year reporting all of the taxable purchases that were not taxed and to pay tax on those purchases.

About Returns & Exchanges

You can return item(s) by mail or in any Zebulun FashionSquare store.

RETURNING BY MAIL (U.S.)
If you have an account or an order number, you can start your return now. If you don’t have an account or you’re missing order information, you can print a blank return form and label Send in your item(s) using the postage-paid U.S. return label. Your return will be processed within 10-14 business days.

RETURNING IN STORES (U.S.)
Simply bring the item(s) you’d like to return along with your receipt and original form of payment. Any salesperson can assist you with your return.

EXCHANGES
For the best service and selection, please order your replacement items online

EXCEPTIONS & SPECIAL INSTRUCTIONS
Please email customer service at returns@zaiylee.com for assistance returning oversized items, perishable goods or other unusual merchandise.

REFUNDS
All refunds will be credited to your original form of payment or a Zebulun FashionSquare Store Credit. When returning a gift, you’ll receive your refund only on a Zebulun FashionSquare Store Credit. If we choose to provide a refund and no record of sale is available, we will ask for personal identification and a return will be provided at current price on a Zebulun FashionSquare Store Credit. (Store Credit cannot be redeemed for cash unless required by law.)

  • Items Returned by Mail: If you ordered by credit card, we’ll credit your account within 14 business days. This will show on your next statement, depending on the issuing bank and/or billing cycle. If you have requested an exchange, your account will be charged for the new item and credited for the return. If you paid with a Store Credit the entire merchandise amount will be refunded back to your Store Credit.
  • Shipping Charges: Unfortunately, we cannot refund shipping charges.

GIFT CARDS
Gift Cards can’t be returned.

FINE JEWELRY
Please follow the instructions included in your shipment and fill out the return section of the packing slip when returning fine jewelry by mail. Return your package via the carrier of your choice, with return signature required. For your protection, you must insure the package for the value of the item enclosed. Fine jewelry can also be returned to Zebulun FashionSquare stores that have a Fine Jewelry department. Simply bring the packing slip and/or credit card used when you placed the order.

INTERNATIONAL RETURNS
International orders have a different return process and do not qualify for free returns or merchandise exchanges. For a refund that includes duties, taxes and tariffs, please contact  returns@zaiylee.com and ask them to send you a Return Merchandise Authorization form. Orders returned directly to a store will receive a refund for the merchandise but not duties, taxes or tariffs.

GREEN SHIPPING

Your receipt or order number helps us locate your purchase the fastest. If you don’t have a receipt, we should be able to find the purchase in other ways, but we may ask you for more information so we can better assist with your request. If no record of sale is available and we choose to provide a refund, your personal identification will be required to process the return and the return is provided at current price on a Zebulun FashionSquare Store Credit.

Do you take everything back? 
We’ll do our best to take care of you, but from time to time we cannot accommodate a return.

Is there a time limit? What if the item is worn? 
We will do our best to take care of customers and deal with them fairly; we ask that our customers treat us fairly as well. We may not accept a return older than 30 days.

Why do special-occasion dresses and some designer items have tags that say if the tag is removed the garment cannot be returned? 
Customers have told us that they want to ensure the special-occasion dresses and designer items they’re purchasing have not been worn prior to their purchase. Over the years, we have also found that we received a disproportionate number of returns of what appeared to be worn special-occasion dresses and designer items. To help in both instances, we implemented a tag or card to help ensure these items are returned in original condition with tags still attached.

Are there restocking fees? 
No.

Why does Zebulun FashionSquare request my personal identification for a return without a record of sale? 
Because of our liberal return philosophy, we have this internal auditing procedure to give us the ability to monitor and investigate refunds and returns without a record of sale.
